Cycle Hire Agreement - Please Read
This hire agreement is made between the party identified as the hirer overleaf and Standalone Farm (Standalone Farm, Wilbury Road, Letchworth Garden City, Hertfordshire, SG6 4JN) 1. The HIRE PROVIDER agrees to hire the cycle(s) and associated equipment to the HIRER as stipulated overleaf. 2. The cycle(s) must be used for the purpose detailed overleaf. If the cycle(s) is used for higher levels of activity (such as racing, stunts or off road mountain biking) which have heavier wear and tear and can cause damage to the cycle and/or associated equipment the higher hire charge will be applied. In instances where this is determined on return of the cycle(s) the additional charge will be taken from the deposit. 3. During the period of hire, use and security of the cycle(s) and associated equipment shall be the responsibility of the HIRER. 4. The HIRER is responsible for all third party liability, any personal injury and all other such liabilities. 5. The HIRE PROVIDER does not accept any responsibility for any loss or damage howsoever arising from the hire of the cycle(s) and associated equipment to the HIRER or any other liability, unless it arises from any negligent act or default on the part of the HIRE PROVIDER. 6. The HIRE PROVIDER will ensure that the cycle(s) pertaining to this agreement is in a roadworthy condition when supplied to the HIRER. During the term of this agreement, the HIRER is responsible for maintaining the cycle(s) and any associated equipment and for ensuring that the cycle(s) remains roadworthy and safe to use. 7. The HIRER should ensure that any users of the cycle(s) are of a sufficient standard of health and ability necessary for the stated use and for riding on public roads in urban, suburban and rural conditions. 8. Users of the cycle(s) should ride in a safe and responsible manner and make optimum use of suggested cycle routes, cycle paths and bridleways. 9. A cycle helmet is supplied with each cycle and it is the HIRE PROVIDER’s recommendation that this should be worn at all times. The HIRE PROVIDER also recommends the wearing of high visibility clothing. 10. A ‘D-Shackle’ lock is supplied with each cycle. The HIRER agrees that when the Cycle(s) is unattended it is secured to an immovable object (ideally a recognised secure cycle stand) by means of the D-shackle security fitting as a minimum requirement. The HIRER also agrees that, when not in use, the cycle(s) will be kept in secure storage inside locked premises or in a locked shed. 11. If a cycle is lost or stolen, on discovery of the theft or loss it should IMEDIATELY be reported to the Police and at the first opportunity (no more than two [2] hours) to the HIRE PROVIDER. 12. In the event that any cycle is damaged in a manner to render it unroadworthy, the HIRER will pay to the HIRE PROVIDER the ‘value’ sum stated overleaf within 28 days of the sum being demanded by the HIRE PROVIDER. 13. The HIRER will pay the HIRE PROVIDER all reasonable costs up to the value sum to repair any damage done to the cycle or associated equipment whilst loaned to the HIRER under this agreement within 28 days of the sum being so demanded by the lender together with the production to the borrower of valid receipts for the repair. 14. The HIRER will pay to the HIRE PROVIDER the full replacement cost of any associated equipment that is lost, stolen or damaged beyond repair whilst hired to the HIRER under this agreement within 28 days of the HIRE PROVIDER producing to the HIRER a valid receipt for the replacement, such replacement to be on a like for like basis. 15. At the end of the hire period the HIRER will return the cycle(s) and associated equipment to the HIRE PROVIDER in good condition.
